Did you know that under California law Government Code § 12940, a request for a reasonable accommodation is a protected activity based on religion or disability constitutes protected activity?
An employer may not retaliate against any employee making such a request. Also, Civil Code § 51, known as the California Unruh Civil Rights Act, provides that all persons within California are entitled to full and equal accommodation in all business establishments regardless of their race, sex, color, religion, ancestry, national origin, disability, medical condition or genetic information.
The categories have now expanded to include citizenship, primary language, and immigration status. Those protections did not require provision of services or documents in a language other than English. Note, now the protection of discrimination has been expanded to included citizenship, primary language and immigration status.
This should be a factor for all individuals to understand if they feel that they have been discriminated or a particular injury that they wish to pursue.
